Terms and Conditions for Kalista Marketing

4. Payment Terms

a. Pricing: The cost of services will be detailed in the pricing plan and/or service agreement and/or invoice provided.

b. Payment Schedule: Payments are due as specified in the service agreement. Failure to pay on time may result in suspension or termination of services.

c. Late Payments: us at Kalista Designs and us who own/work for/are private contractors for Kalista Designs may cancel any clients order for any reason without any warning if the client is late on a payment, or the payment does not go though. 

5. Cancellation and Refund Policy

a. Cancellation by Client: Clients may cancel services by providing 10 days' written notice. Refunds will be provided based on the work completed up to the cancellation date, minus any non-refundable expenses.

b. Cancellation by Kalista Marketing: We reserve the right to cancel the service at any time. If we cancel the service, we will provide a prorated refund for the remaining service period.

6. Confidentiality

We are committed to maintaining the confidentiality of any information provided by the client. We will not disclose any confidential information without the client’s prior written consent.

7. Limitation of Liability

a. General Limitation: Kalista Marketing will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our services.

b. Variance in Views: Kalista Marketing is not responsible for any variances in views or opinions resulting from the interpretation or use of our services. The outcomes of our services may vary based on numerous factors beyond our control, and we do not guarantee any specific results.

8. Intellectual Property

All intellectual property rights concerning the services and materials provided by Kalista Marketing remain the property of Kalista Marketing.

9. Termination

We may terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms, or if we believe and/or think that you did.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

11. Changes to Terms

We reserve the right to modify these terms at any time. It is your responsibility to review these terms periodically. Your continued use of our services following the posting of any changes to these terms will signify your acceptance of those changes.
